Providing Peace of Mind
Your Will is an important document. It tells your family and friends what you want to happen with your estate once you have passed. While it is not always a priority, the making of your will can often bring peace of mind, and you can relax in the knowledge that your family will be taken care of and your wishes will be carried out.
Inheritance tax can often be a burden that families have to manage after the passing of a loved one with no knowledge or insight into the correct procedures. The payment of substantial inheritance tax can be avoided by getting the right advice from a legal expert.
We offer a full Will writing service, taking care of all the necessary legal documentation, form filling, and tax planning.
Preparing a Will
It is a good idea to have some notes prepared before you speak to us about your Will. You can start by:
- Making a list of your entire estate (your property and belongings)
- Making a list of beneficiaries.
- Providing another beneficiary name, should your beneficiary predecease you.
- Deciding who you would like to be the executors of your Will (those responsible for ensuring the terms of your will are carried out)
- You may also want to make arrangements for the care of your children should you die before they are grown up.
- Detail your funeral arrangements and wishes for the service, including burial or cremation.
- Finally, consider organ donation or other plans you wish to be carried out.
The last few points, while not specifically with regards to your estate, may be of real help to your family during the tough time following your passing.
Upon instruction, we shall provide you with standard forms to complete which will help collate all the relevant information we require to draft and prepare your Will.
Our solicitors will discuss your options with you and advise on the best type of Will for the outcome you desire.
Inheritance Tax Planning
We always ensure that your Will is written with Inheritance Tax in mind. In the absence of careful tax planning, families can lose thousands of pounds to taxation. This is where writing your own Will without assistance can be very risky. We provide bespoke advice alongside our Will preparation advice, ensuring you and your loved one’s interests are properly looked after.
Reviewing Your Will
Things change; It may be that you have had more children or grandchildren since you last reviewed your Will; you may have married or have separated from your partner; your assets may have increased or decreased (an increase may affect Inheritance Tax); or the value of your house may have significantly changed, which may mean you want to re-evaluate your Will.
We would recommend reviewing your Will every five to six years. We provide a Will reviewing service, making recommendations on how to progress should your Will require amendment, whether it be a full Will re-write or the addition of a codicil (an official attachment to a Will).
